By accessing or using NeuroSpicy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Varnish Labs LLC ("we", "us", "our"), a company registered in the State of Washington.
If you do not agree to these Terms, do not use the Service.
NeuroSpicy is an energy and mood tracking application designed for neurodivergent individuals. The Service allows you to log energy and mood check-ins, view pattern analysis through signals, track activities, connect with friends, and access educational content.
The Service is not a medical device, diagnostic tool, or substitute for professional medical advice. The signals and insights provided are based on your self-reported data and published research, but they are not clinical assessments.
To use the Service, you must create an account using a valid email address or a supported third-party authentication provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

You retain ownership of any content you submit to the Service, including energy logs, mood logs, activity logs, feedback submissions, and knowledge base articles (if you are a staff member).
By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of operating and improving the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
The Service offers both free and paid subscription tiers. Free features include basic energy tracking and core signals. Paid tiers provide access to additional features as described on the Service.
If you subscribe to a paid tier, you agree to pay the applicable fees. We reserve the right to change pricing with reasonable notice. You may cancel your subscription at any time.
The Service, including its design, code, signals, educational content, and branding, is owned by Varnish Labs LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Varnish Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, regardless of the theory of liability.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
You may request an export of your data or deletion of your account at any time through the Settings page. Upon account deletion, your personal data will be permanently removed from our systems within 30 days, except where retention is required by law.
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the Service ceases immediately.
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of the State of Washington.
